A Inocência da Modernidade: Os Limites entre a Liberdade de Expressão e o "Sagrado" Religioso e Civil

Resumo: As nações ocidentais, de tradição secular, consagraram as liberdades, entre elas a de expressão, como valores jurídico-morais indisponíveis, tratando com estranheza a reação acalorada de indivíduos ou nações muçulmanas contra filmes, artigos, charges ou livros que tratem o Islã de forma depreciativa ou vexatória, ratificando a impressão de atraso cultural e, por parte do observador crítico, de superioridade civilizacional do Ocidente. Entretanto, quando a liberdade de expressão atenta contra valores consagrados dentro um sociedade secular, dependendo da repercussão, são justificáveis respostas apaixonadas e duras da comunidade. A justificativa básica é que a liberdade não pode afrontar contra o valor maior da Dignidade da Pessoa. Logo, o texto visa analisar a relação e os “limites” da liberdade de expressão com os valores considerados sagrados, dentro de uma comunidade ou sociedade, bem como suas implicações perante a identidade coletiva. A fim de atingir esse objetivo, é importante entender que a sacralidade não éum fenômeno valorativo exclusivo de sociedades religiosas, mas está presente em coletividades seculares, encontrando-se nos valores morais compartilhados. Estas questões em verdade apresentam um problema maior, a saber, a dificuldade de reconhecimento e de tolerância entre grupos, povos e civilizações.

Abstract: Western nations, with their secular tradition, enshrined freedoms, including the freedom of expression, as untouchable legal-moral values, dealing with bizarreness the radical reactions individuals from Muslim nations can have against films, articles, cartoons or books treating the Islam with a derogatory or insulting manner, confirming the impression of cultural backwardness, and, from the stand point of critical observers, of civilizational superiority of the West. However, when freedom of expression insult values enshrined in a secular society, depending on the repercussions, is justifiable as passionate and harsh responses from the community. The basic rationale is that freedom cannot reproach against the higher value of the Dignity of the Person. In this context, this paper aims to analyze the relationship and the "limits" of freedom of expression regarding the values considered sacred within a community or society, as well as its implicationsto the collective identity. In order to reach this objective, it is important to understand that sacredness is not an unique phenomenon of evaluative religious societies, but it is also present ins ecular communities, lying on shared moral values. These issues have in fact a bigger problem, i.e., that one of the difficulty of recognition and tolerance between groups, peoples andc ivilizations.
